By accessing and using the Elepay Intelligence platform ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Elevare Pay Easy Pty Ltd (A.C.N. 634 728 591), trading as Elepay ("we", "us", or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on the Service.

Elepay Intelligence provides property styling analytics and data services, including but not limited to: • Property styling outcome tracking and measurement • Comparable property data analysis • ROI calculations and reporting • Integration with third-party data providers including CoreLogic • Partner portal access for property styling professionals • Marketing materials and data cards The Service is designed for use by property professionals, real estate agents, and property styling companies within Australia.

To access certain features of the Service, you must register for an account. When registering, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities under your account • Notify us immediately of any unauthorized use We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process property data, user information, and analytics data to provide and improve the Service. By using the Service, you consent to: • The collection and processing of data as described in our Privacy Policy • The use of cookies and similar technologies • The sharing of data with our partners and service providers as necessary Property data displayed on the platform may be subject to third-party licensing agreements and usage restrictions.

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Elepay or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not: • Reproduce, distribute, or create derivative works from our content • Use our trademarks or logos without prior written permission • Reverse engineer, decompile, or disassemble any software components • Remove any copyright or proprietary notices from materials Limited license is granted to access and use the Service for its intended purpose.

To the maximum extent permitted by law, Elepay shall not be liable for: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, data, use, goodwill, or other intangible losses • Any damages resulting from unauthorized access to your account • Any interruption or cessation of the Service • Any errors or omissions in content or data Our total liability for any claims arising from your use of the Service shall not exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding the claim. Property data and ROI calculations are provided for informational purposes only and should not be relied upon as guaranteed outcomes.

You agree to indemnify, defend, and hold harmless Elepay, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Any content you submit or share through the Service

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination: • Your right to use the Service will immediately cease • We may delete your account and any associated data • Provisions that by their nature should survive termination will remain in effect You may terminate your account at any time by contacting our support team.

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Victoria, Australia. You consent to the personal jurisdiction of such courts.
